Personal Data Is Everywhere in Your Business

The Risk Today

Employee, customer and patient data spread across many systems
No proof that people gave consent
Anyone in the team can open sensitive records
No plan for what to do when a breach happens
Under DPDP, each of these can lead to a complaint and a heavy penalty.

FAQ

DPDP Act: Frequently Asked Questions

What is the DPDP Act?
The Digital Personal Data Protection Act, 2023 is India's law on how organisations collect, use, store and delete personal data in digital form. The DPDP Rules, 2025, notified in November 2025, explain how to comply.
Does the DPDP Act apply to my business?
Yes, if you hold personal data of people in India in digital form: employees, customers, patients, students or leads. It applies to businesses of every size, including data collected on paper and later digitised.
What is the deadline?
Most duties, including consent, notices, security safeguards, breach reporting and people's rights, must be in place by 13 May 2027, 18 months after the Rules were notified. The government has said it may shorten this window.
What are the penalties?
The Data Protection Board can impose penalties of up to ₹250 crore for failing to take reasonable security safeguards, and up to ₹200 crore for failing to report a breach or to meet duties for children's data.
What must we do when a data breach happens?
Inform the Data Protection Board and each affected person without delay, and send the Board a detailed report within 72 hours of becoming aware of the breach, as set out in the DPDP Rules.
Do we have to replace our existing software?
Not always. We first assess your current systems. Where possible we upgrade them with consent capture, access control and audit logs. Where that is not practical, we move you to our DPDP-ready modules.
Is BS Teknology a law firm?
No. We provide DPDP-ready software and compliance consulting. Legal opinions and privacy notices on our projects are reviewed with our partner advocates.
